These Terms of Service ("Terms") govern your use of Health Data Export ("the App"), a mobile application for exporting health data from Apple HealthKit. By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Health Data Export, you confirm that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You agree to comply with all applicable laws and regulations
• You have read and understood our Privacy Policy

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on iOS devices you own or control
• Use the App for personal, non-commercial purposes
• Export your own health data from Apple HealthKit

3. Pricing and Optional Tips

Optional Tip Jar

While the app is entirely free, we offer an optional tip jar for users who find the app valuable and wish to support development:

• Voluntary: Tips are completely optional and do not unlock any features
• One-Time Purchase: Tips are one-time, non-consumable purchases (not subscriptions)
• No Recurring Charges: Tips do not auto-renew or create any ongoing payment obligations
• Payment: Charged to your Apple ID account at confirmation of purchase
• Multiple Tips: You can leave multiple tips if you wish to support the app over time

Refunds for Tips

• Refund Requests: All purchases are processed through Apple. To request a refund for a tip, contact Apple Support at https://support.apple.com/billing or via the App Store
• Refund Policy: Apple determines eligibility for refunds according to their standard policies

4. Permitted Use

You agree to use Health Data Export only for lawful purposes. You may NOT:

• Export health data belonging to another person without their consent
• Use the App to violate any privacy laws or regulations
• Reverse engineer, decompile, or disassemble the App
• Distribute, sell, or sublicense the App to third parties
• Use the App for commercial purposes without our written consent
• Attempt to circumvent any limitations or restrictions in the App

5. Health Data and Medical Disclaimer

You acknowledge and agree that:

• The App does not provide medical advice, diagnosis, or treatment
• Exported data should not be used as a substitute for professional medical advice
• You should always consult a qualified healthcare provider for medical questions
• We are not responsible for any health-related decisions you make based on exported data
• The accuracy of exported data depends on the accuracy of data in Apple Health

6. Data Accuracy and Liability

While we strive to ensure accurate data export, you acknowledge that:

• Exported data is only as accurate as the source data in Apple HealthKit
• We do not guarantee the completeness, accuracy, or reliability of exported data
• You are responsible for verifying exported data before relying on it
• We are not liable for any decisions made based on exported data

7. Intellectual Property

All rights, title, and interest in Health Data Export, including all software, designs, graphics, and documentation, are owned by us or our licensors. These Terms do not grant you any ownership rights.

8. Privacy and Data Collection

Your use of the App is governed by our Privacy Policy. Key points:

• Your health data NEVER leaves your device
• We do not upload, store, or transmit your health data
• Exported files are stored locally on your device
• You control what data is exported and where files are saved

9. Third-Party Services

The App integrates with:

• Apple HealthKit: Subject to Apple's terms and policies
• Apple App Store/StoreKit: Purchases are subject to Apple's terms

We are not responsible for any third-party services or their policies.

10. Termination

We reserve the right to:

• Suspend or terminate your access to the App at any time for violation of these Terms
• Discontinue the App or any features at any time with or without notice
• Modify or update the App at our discretion

You may terminate your use by deleting the App from your device.

11. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of exported data

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not liable for data loss, health consequences, or decisions made based on exported data

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any health-related decisions made based on exported data

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date at the top of this page
• Posting a notice in the App

Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the United States and the state in which you reside, without regard to conflict of law provisions.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

16. Apple-Specific Terms

As required by Apple:

• These Terms are between you and us, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for the App or any claims relating to it
• In the event of any third-party claim that the App infringes intellectual property rights, we (not Apple) are responsible
• Apple and its subsidiaries are third-party beneficiaries of these Terms

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

Health Data Export is an independent app and is not affiliated with Apple Inc.
